This is the first appraisal report of Minister’s papers that are submitted for the ITD process under the Public Records Act 2005 (the Act). Archives New Zealand previously processed Ministers’ papers as if they were private records and they were not required to go through the ITD process.
However, in 2015 we received legal advice regarding Ministers’ papers. This advice confirmed that Ministers fall within the definition of public office. Accordingly, any information and records of Ministers in their official capacity as Ministers would be public records and may not be disposed of without the Chief Archivist’s authority.
